General Terms & Conditions

Lagom World Ventures LLP is an entity existing under the laws of India, conducting business, under the brand name “Lagom” (the “Website Provider”) provides the content and services available on its website (www.lagomworld.in), referred to as “Site”) to you subject to the following Terms and Conditions and the Privacy Policy and other terms and conditions and policies which you may find throughout our Site all of which are deemed a part of and included within these terms and conditions (collectively, “We” & “Us”).

1. General

 

By accessing or using this Site, you acknowledge that you have read, understood, and you agree, without limitation or qualification, to be bound by these Terms and Conditions. Please read these Terms and Conditions of Use carefully before using our Web Site and the Services. If you do not agree to these Terms, please refrain from using the Web Site and exit immediately.

2. Privacy

 

Please review our privacy policy so that you may understand our privacy practices.

3. Pricing and Payment

 

Our Site displays the prices of products in Indian rupees. For Indian Customers, GST will be charged as specified.

Prices, products and services may change at the discretion of the Website Provider.

We reserve the right to correct any errors, inaccuracies or omissions which may relate to product descriptions, pricing, offers and availability and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order) Your continued use of our Web Site following the posting of changes to these terms will mean you impliedly accept those changes. Any such changes shall be effective immediately upon lagom posting thereof. Any use of the site by you after such notice shall be deemed to constitute acceptance by End User of such modifications.

The Site uses the services of a third party payment processing provider for processing payments made on the Site. Your use of the payment gateway will be subject you adhering to the terms and conditions of use prescribed by the payment processing provider(s). You acknowledge and understand that the payment gateway services made available through the Site are owned, controlled and provided by the payment processing provider(s) and hence, the Website Provider does not warrant and in no way will be liable for the timeliness of such services and the handover of payments through such services.

We shall not be liable in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of the cardholder having exceeded the preset limit mutually agreed by us with our bank from time to time.

4. Delivery and shipping

 

We endeavour to deliver all orders within 7 days of receipt of the order. In some of our products, the delivery times could be higher, and could, on occasions, extend beyond the time indicated in the product description. We will, however, try and keep this to a minimum.

Sales are “first come, first served”. The goods may take time to restock. We will do our best to restock as soon as possible.

Shipping charges are applicable for all orders below INR 2,000 in Bengaluru and INR 2,500 outside Bengaluru. Note that shipping charges vary depending on the place of delivery within India.

All deliveries require the named person’s signature, so please ensure you are available at your selected delivery address.

We also reserve the right to cancel your order due to issues arising out of inventory or other internal issues or issues such as strikes, interstate regulations, delivery outage etc. We will, however, inform you of cancellation of your order and will offer you an opportunity of refund till the time the situation returns to normal.

5. Insurance 

 

Lagom insures each purchase during the time it is in transit until it is delivered to you. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by Lagom and transfer of responsibility in the same way.

6. Return, exchange and cancellation

 

We believe in happy customers. Since Wild Ideas™ products are hand made, and using natural ingredients, there could be some variations in the end product. Lagom’s return policy is made keeping our valuable customers in mind, with easy transparent procedure for it. We hope that you won’t need to use the policy as far as possible but we do understand that there could be unforeseen conditions under which it becomes necessary to replace/return the product.

At Lagom, each product is checked, verified and then shipped to the customer but we do understand that errors can happen at production and during packing.

Defective and damaged products

 

Lagom will replace products that are found to be defective or damaged. Defective products are classified under the following 2 categories:

1) Buyer getting the wrong product; and

2) Empty bottle/refills without product

Damaged products are classified as those that have arrived broken, leaked and incapable of being used.

The buyer is expected to inform the Company within 2 days of receipt of items and provide proof of damage/defect, failing which the company takes no responsibility to replace the product/s at its own cost.

You may send a mail to engage@lagomworld.in with the Subject line: Replacement for Order no XXXX along with photographs/video. Lagom will revert within 24 to 48 hours and arrange to pick up the defective or damaged product/s from your doorstep. Note that returned/exchanged goods should retain the original label. Lagom may deliver a replacement at the time of pick up or within 7-10 days of pick up.

Cash refund/exchange is made only for damaged product. Does not include logistics charges. For further details, please write to engage@lagomworld.in with the subject line: Replacement of order no xxx.

Do not like the product

 

We understand that in some cases that you may not like the Wild Ideas™ product which you have received. There might be several reasons for the same. However, note that Lagom does not take responsibility for the same and shall not be liable to replace the product. However, if you should still want to return the product, Lagom will deduct INR 75/- for every item returned as pickup and processing fee. This is applicable for unopened products. Opened products will not be taken back. Logistics cost will not be considered for refund. Also, the buyer is expected to pack the product safely and keep it ready for pickup.

However note that only products sold at full price are eligible for Return. Please mail at engage@lagomworld.in with order number and reason for return.

7. Products and services for personal use

 

The products and services described on this Site are for your personal use only. Any resale of merchandise purchased from the Website Provider will not be permitted without prior permission.

We reserve the right to refuse or limit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors, or otherwise violate these Terms and Conditions. If we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail, mailing address or telephone number provided at the time the order was made.

8. Accuracy of information

 

We attempt to be as accurate as possible when describing our products on the Site. However, except to the extent implied by applicable law, we do not warrant that the product descriptions, colours, information or other content available on the website are accurate, complete, reliable, current, or error-free.

9. Intellectual property rights

 

All information and content available on the Site and its get-up and design, including but not limited to trademarks, logos, service marks, text, graphics, button icons, images, audio clips, data compilations and software, and its arrangement, selection, compilation and organization, (collectively, the “Content”) is the property of the Website Provider and is protected by the laws of India, including laws governing all applicable forms of intellectual property.

Except as permitted under applicable law, neither the Content nor any portion of this Site may be used, reproduced, duplicated, copied, sold, resold, modified, or otherwise exploited, in whole or in part, for any purpose without our express, prior written consent.

10. Your obligations and responsibilities

 

In the access or use of the Site, you shall comply with these Terms and Conditions and shall act always in accordance with the law, custom and in good faith. You may not make any change or alteration to the website or any Content or services that may appear on this website and may not impair in any way the integrity or operation of the website. Without limiting the generality of any other provision of these Terms and Conditions, if you default negligently or wilfully in any of the obligations set forth in these Terms and Conditions, you shall be liable for all the losses and damages that this may cause to the Website Provider, our partners or any other person/entity that we work with.

11. Representations, Warranties and Limitation of Liability

 

Lagom through its website and online store www.lagomworld.in is engaged exclusively in promoting and retailing handcrafted products made by Wild Ideas Trust, a rural women cooperative based out of Tiruvannamalai in Tamil Nadu, under its brand name Wild Ideas™. Lagom also represents the Wild Ideas brand at various events and exhibitions, and work with corporate entities to introduce Wild Ideas Trust and its wide range of products to their employees.

You understand that all the products sold through the Site are locally sourced and hand-made with the intent of promoting a chemical free lifestyle without compromising quality. Therefore, you expressly acknowledge that there may be variations in the products due to certain factors including but not limited to climatic conditions, seasonal changes, traditional processes etc.

Wild Ideas™ handcrafted products are based on natural formulations. Significant effort and precautions have been taken to render the products safe; however, it is possible that certain ingredients may cause allergic reactions to certain individuals with pre-existing medical conditions. Lagom and Wild Ideas Trust will not be responsible or liable for any product related issues that result in allergic reactions to the user. All ingredients used in Wild Ideas™ product formulations are clearly mentioned in the product description and label, and users are advised to read and understand before purchasing the product.

It is also agreed that the quality of Wild Ideas™ products may not meet your expectations, and agree that the website and online store is not liable to take responsibility for the same and shall not be liable to replace the product.

12. Indemnification

 

You agree to defend, indemnify and hold us harmless for any loss, damages or costs, including reasonable attorneys’ fees, resulting from any third party claim, action, or demand resulting from your use of the Site or breach of these Terms and Conditions. You also agree to indemnify us for any loss, damages, or costs, including reasonable attorneys’ fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

13. Disputes

 

With respect to any dispute regarding the website, all rights and obligations and all actions contemplated by these Terms and Conditions shall be governed by the laws of India and the courts of Bengaluru, India.

In case any dispute cannot be resolved amicably at the first instance, the dispute shall be referred to a sole Arbitrator. The arbitration will be governed by the Arbitration Act, 1996. The seat and venue of such arbitration shall be at Bengaluru, India and the award of the Arbitrator shall be final and binding on all parties and may be entered as a judgment in any court of competent jurisdiction.

14. Governing law

 

These Terms and Conditions shall be governed by and constructed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of the competent courts at Bengaluru, Karnataka.

15. Severability

 

If any provision of the Terms and Conditions is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall be applicable only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms and Conditions shall continue to be in full force and effect.
